Background
A development application was approved by the Metro Outer Development Assessment Panel (MODAP) on 29 November 2023 for a Showroom and Fast Food/Takeaway Development at Lot 806 South Western Highway, Byford. The applicant has subsequently appealed the decision to the State Administrative Tribunal (SAT).
As part of the SAT process, the applicant seeks to either amend or remove the following conditions of the original decision: b.i, b.ii, b.iii, b.iv, b.v, b.vi, b.viii, c, i.iv, k, I, m, o, p, q and s.
This has resulted in the SAT inviting MODAP to reconsider its decision and as such the Shire is required to make a recommendation to the MODAP.
